We are pleased to share that Ashtar Ali & Rahim LLP successfully represented a state-owned enterprise in an appeal before the Public Procurement Regulatory Authority.
The appeal, filed by a bidder, challenged the Grievance Redressal Committee’s dismissal of the bidder’s complaint in relation to the SOE’s decision to annul procurement proceedings and reissue the bid with a revised criteria.
In a comprehensive order, PPRA agreed with the firm’s position that a procuring agency has complete discretion under Rule 33 of the PPRA Rules, 2004, to reject all bids prior to acceptance of any bid and that no vested right for grant of contract is created for a bidder under Rule 38.
